এই ওয়েবসাইটটি ShopZ (shopz.com.bd) দ্বারা পরিচালিত। এই সাইটে "আমরা", "আমাদের" বলতে shopz.com.bd কে বোঝানো হয়। আমাদের সাইট ভিজিট করে বা আমাদের কাছ থেকে কিছু ক্রয় করে আপনি নিচে বর্ণিত সমস্ত শর্তাবলীতে সম্মত হচ্ছেন। অনুগ্রহ করে সাইট ব্যবহারের আগে এই শর্তাবলী মনোযোগ দিয়ে পড়ুন।

১। সাধারণ শর্তাবলী (General Conditions)

এই শর্তাবলীতে সম্মত হওয়ার মাধ্যমে আপনি নিশ্চিত করছেন যে আপনি প্রযোজ্য আইন অনুযায়ী সংখ্যাগরিষ্ঠ বয়সী। আপনার অপ্রাপ্তবয়স্ক নির্ভরশীলদের সাইট ব্যবহারের জন্য আপনার সম্মতি প্রদান করা হয়েছে বলে গণ্য হবে।

আমাদের পণ্য বা সেবা কোনো অবৈধ বা অননুমোদিত উদ্দেশ্যে ব্যবহার করা যাবে না। কপিরাইট আইনসহ আপনার এখতিয়ারের যেকোনো আইন লঙ্ঘন করা নিষিদ্ধ। কোনো ক্ষতিকর কোড বা ভাইরাস প্রেরণ করা যাবে না এবং শর্তাবলী লঙ্ঘনের ক্ষেত্রে আপনার সেবা তাৎক্ষণিকভাবে বন্ধ করা হবে।

আমরা যেকোনো কারণে যেকোনো সময় যে কাউকে সেবা প্রদান অস্বীকার করার অধিকার সংরক্ষণ করি। আমাদের লিখিত অনুমতি ছাড়া সাইটের কোনো অংশ পুনরুৎপাদন, বিক্রি বা ব্যবহার করা নিষিদ্ধ।

২। মূল্য নির্ধারণ (Pricing)

আমাদের পণ্যের মূল্য পূর্বনোটিশ ছাড়াই পরিবর্তন হতে পারে। আমরা যেকোনো সময় যেকোনো সেবা পরিবর্তন বা বন্ধ করার অধিকার রাখি এবং এর জন্য আমরা আপনার বা তৃতীয় পক্ষের প্রতি দায়ী থাকব না।

বিশেষ নোটিশ

বাংলাদেশে USD রেট ওঠানামার কারণে আমদানিকৃত পণ্যের মূল্য সম্পূর্ণ অস্থিতিশীল থাকতে পারে, যা আমাদের নিয়ন্ত্রণের বাইরে। কোনো কারণে বিক্রেতা পণ্য সরবরাহ করতে ব্যর্থ হলে আমরা নোটিশ ছাড়াই অর্ডার বাতিল করার অধিকার সংরক্ষণ করি। ৭ কার্যদিবসের মধ্যে আপনি SMS, Email বা App/Website-এর মাধ্যমে অর্ডার স্ট্যাটাস জানতে পারবেন।

৩। পণ্য সংক্রান্ত (Products)

পণ্যগুলো শুধুমাত্র ওয়েবসাইটের মাধ্যমে পাওয়া যায় এবং সীমিত পরিমাণে থাকতে পারে। পণ্য ফেরত শুধুমাত্র আমাদের Return Policy অনুযায়ী গ্রহণযোগ্য।

আমরা পণ্যের রঙ ও ছবি যতটা সম্ভব সঠিকভাবে প্রদর্শনের চেষ্টা করি, তবে মনিটরের ডিসপ্লের কারণে রঙে পার্থক্য হতে পারে। কোনো গ্রাহক পণ্যের সত্যতা নিয়ে অভিযোগ করলে আমরা ১৫–৩০ কার্যদিবসের মধ্যে পণ্য প্রতিস্থাপন বা অর্থ ফেরত দেওয়ার ব্যবস্থা করব।

আমরা পণ্যের পরিমাণ, বিক্রয় এলাকা ও প্রাপ্যতা সীমিত করার অধিকার সংরক্ষণ করি। যেকোনো সময় পণ্যের বিবরণ ও মূল্য পরিবর্তন করা হতে পারে।

৪। বিলিং ও অ্যাকাউন্ট তথ্যের নির্ভুলতা (Billing & Account Information)

আমরা যেকোনো অর্ডার প্রত্যাখ্যান করার অধিকার রাখি। একই গ্রাহক, পেমেন্ট মেথড বা ঠিকানায় প্রতি অর্ডারে পরিমাণ সীমিত করা হতে পারে।

প্রতিটি অ্যাকাউন্ট অবশ্যই একটি নির্দিষ্ট ও অনন্য মোবাইল নম্বর এবং ইমেইল দিয়ে তৈরি করতে হবে। একই তথ্য দিয়ে একাধিক অ্যাকাউন্ট তৈরি করলে তারা কোনো অফার, ডিসকাউন্ট বা গিফট কুপন সুবিধা পাবেন না।

সঠিক ও আপডেট তথ্য (ইমেইল, ফোন, পেমেন্ট তথ্য) প্রদান করা আপনার দায়িত্ব, যাতে আমরা লেনদেন সম্পন্ন করতে পারি।

৫। ছাড় ও অফার (Discounts & Allowances)

কুপন কোড, প্রমো কোড বা অন্যান্য অফার পণ্যের মূল মূল্য থেকে হ্রাস করা হয়। সফল অর্ডারে কুপন বা গিফট কার্ড ব্যবহার করা হলে, পণ্য ফেরতের ক্ষেত্রে সেই ছাড়ের মূল্য ফেরত দেওয়া হবে না।

Sign-up অফারের মতো একবার ব্যবহারযোগ্য সুবিধা একাধিক অ্যাকাউন্টে একই তথ্য দিয়ে ব্যবহার করা যাবে না। আমরা যেকোনো প্রমোশন বা অফার বাতিল করার অধিকার সংরক্ষণ করি।

৬। তৃতীয় পক্ষের লিংক (Third Party Links)

আমাদের সাইটে থাকা তৃতীয় পক্ষের লিংক বা উপকরণের জন্য আমরা দায়বদ্ধ নই। তৃতীয় পক্ষের সাইটে যাওয়ার আগে তাদের নীতিমালা ভালোভাবে পড়ুন। তৃতীয় পক্ষের সাথে যেকোনো লেনদেন বা অভিযোগ সরাসরি তাদের সাথে নিষ্পত্তি করতে হবে।

৭। ব্যক্তিগত তথ্য (Personal Information)

৮। তথ্যের ভুল ও বাদ পড়া (Errors, Inaccuracies & Omissions)

আমাদের সাইটে মাঝে মাঝে পণ্যের বিবরণ, মূল্য, অফার বা শিপিং চার্জে টাইপোগ্রাফিক ভুল বা অসংগতি থাকতে পারে। আমরা পূর্বনোটিশ ছাড়াই যেকোনো সময় ভুল সংশোধন করার, তথ্য পরিবর্তন করার বা অর্ডার বাতিল করার অধিকার সংরক্ষণ করি।

৯। অর্ডার বাতিলকরণ (Order Cancellation)

ShopZ গুণমানসম্পন্ন ও আসল পণ্য সরবরাহে প্রতিশ্রুতিবদ্ধ। বিক্রেতার কাছ থেকে পণ্য পাওয়ার পর আমরা Quality Control Check পরিচালনা করি। মান নিয়ন্ত্রণে ব্যর্থ হলে অর্ডার বাতিল করার সম্পূর্ণ অধিকার আমাদের রয়েছে।

পণ্য অনুপলব্ধ বা স্টক শেষ হলেও অর্ডার বাতিল করা হতে পারে। ইনভেন্টরি, ওয়েবসাইট বা ভেন্ডর স্টক আপডেটের কারণে পণ্যের অনুপলব্ধতা পূর্বাভাস করা সব সময় সম্ভব নয়।

Cash on Delivery সুবিধা না থাকলে অগ্রিম পেমেন্ট দিতে অস্বীকার করলেও অর্ডার বাতিল করা হবে। ঢাকার বাইরের গ্রাহকদের অর্ডার নিশ্চিত করতে ৳৩০০ টাকা অগ্রিম পেমেন্ট করতে হবে।

১০। নিষিদ্ধ ব্যবহার (Prohibited Uses)

সাইট বা এর কন্টেন্ট নিচের উদ্দেশ্যে ব্যবহার করা সম্পূর্ণ নিষিদ্ধ:

1. অবৈধ বা আন্তর্জাতিক আইন-বিরোধী কার্যকলাপ
2. মেধাস্বত্ব বা কপিরাইট লঙ্ঘন
3. হয়রানি, বৈষম্য বা ভীতি প্রদর্শন
4. মিথ্যা বা বিভ্রান্তিকর তথ্য প্রদান
5. ভাইরাস বা ক্ষতিকর কোড আপলোড
6. অন্যের ব্যক্তিগত তথ্য সংগ্রহ বা স্প্যামিং
7. সাইটের নিরাপত্তা বাইপাস করার চেষ্টা

১১। দায়বদ্ধতার সীমা (Disclaimer of Warranties & Limitation of Liability)

আমরা গ্যারান্টি দিতে পারি না যে সাইটের পরিষেবা সবসময় নিরবচ্ছিন্ন, সময়মতো, নিরাপদ বা ত্রুটিমুক্ত হবে। সেবা ব্যবহার বা ব্যবহারে অক্ষমতার ঝুঁকি সম্পূর্ণভাবে আপনার নিজের।

কোনো পরিস্থিতিতেই ShopZ বা এর পরিচালক, কর্মকর্তা, কর্মী, সরবরাহকারী বা লাইসেন্সধারীরা কোনো প্রত্যক্ষ, পরোক্ষ, আনুষঙ্গিক বা ফলস্বরূপ ক্ষতির জন্য দায়ী থাকবেন না।

আমাদের পণ্যগুলো ব্র্যান্ড বা ম্যানুফ্যাকচারার Warranty বহন করতে পারে, পণ্য পেজে উল্লেখ থাকলে ShopZ-এর মাধ্যমে তা পাওয়া যাবে। তবে ওয়ারেন্টি পলিসির আওতার বাইরের ক্ষতির জন্য ShopZ দায়ী নয়।

১২। ক্ষতিপূরণ (Indemnification)

আপনি সম্মত হচ্ছেন যে ShopZ এবং এর সহযোগীদের এই শর্তাবলী লঙ্ঘন বা কোনো তৃতীয় পক্ষের দাবি থেকে রক্ষা করবেন এবং ক্ষতিপূরণ দেবেন।

১৩। বিভাজনযোগ্যতা (Severability)

এই শর্তাবলীর কোনো অংশ অবৈধ বা অকার্যকর বলে গণ্য হলে, সেই অংশটি বাদ দিয়ে বাকি অংশ সম্পূর্ণ কার্যকর থাকবে।

১৪। সমাপ্তি (Termination)

এই শর্তাবলী আপনার বা আমাদের যেকোনো পক্ষের দ্বারা সমাপ্ত না হওয়া পর্যন্ত কার্যকর থাকবে। শর্তাবলী লঙ্ঘনের ক্ষেত্রে আমরা নোটিশ ছাড়াই যেকোনো সময় এই চুক্তি বাতিল করতে পারি। সমাপ্তির তারিখ পর্যন্ত প্রযোজ্য সমস্ত পরিমাণের জন্য আপনি দায়বদ্ধ থাকবেন।

১৫। প্রযোজ্য আইন (Governing Law)

এই শর্তাবলী বাংলাদেশের প্রযোজ্য ই-কমার্স আইন দ্বারা পরিচালিত ও ব্যাখ্যাযোগ্য হবে।

১৬। শর্তাবলীর পরিবর্তন (Changes to Terms of Service)

By visiting our site and/or purchasing something from us, you engage in our services and agree to be bound by the following terms and conditions. Please read these Terms of Service carefully before accessing or using our website.

1. General Conditions

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction including copyright laws. You must not transmit any worms, viruses or any code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of your services.

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our service without express written permission by us.

2. Pricing

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue any service without notice. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the service.

Special Notice

Due to the current high USD exchange rate, product prices may be completely unstable and beyond our control. If the seller fails to provide the ordered item, we reserve the right to cancel the order without prior notice. You may receive an SMS or email, or check your order status via the app or website within 7 working days.

3. Products

Products are available exclusively online through the website. These products may have limited quantities and are subject to return only according to our Return Policy.

We have made every effort to display product colors and images as accurately as possible. We cannot guarantee that your monitor display will be accurate. If a customer raises a complaint about product authenticity or quality, we will arrange a replacement or refund within 15–30 business days.

We reserve the right to limit the quantities of any products we offer, restrict sales by geographic region, and discontinue any product at any time. All product descriptions and pricing are subject to change at any time without notice.

4. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed under the same customer account, the same payment method, or the same billing and/or shipping address.

Each user account must be created under one unique registered mobile number and email address. Multiple accounts cannot be created under the same information, and in such cases the user will not be able to avail any offers, discounts or gift coupons.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, including keeping your email address and payment details up to date.

5. Discounts & Allowances

Discounts and allowances such as coupon codes, promo codes and occasional offers are reductions to the basic price of products. The value of any coupon discount or gift card used on a successful order will not be refunded in the event of a return.

One-time account offers such as sign-up allowances cannot be used more than once, even across multiple accounts created with the same information. We reserve the right to refuse or cancel any promotion or offer at any time.

Certain content, products and services available via our service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. 9. Order Cancellation

ShopZ is committed to delivering quality and authentic products to our customers. We run Quality Control Checks after receiving ordered products from the seller. We reserve the right to cancel any order if a quality issue is found during this check.

We also reserve the right to cancel any order if the product is unavailable or out of stock. Product unavailability cannot always be predicted due to inventory management, website issues or vendor stock updates.

We reserve the right to cancel any order if the customer refuses to make an advance payment in cases where Cash on Delivery is not available. Customers outside Dhaka are required to pay ৳300 in advance to confirm their order.

10. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content for any of the following purposes:

1. Any unlawful purpose or to solicit others to perform unlawful acts
2. Violating any international, federal or local regulations, rules or laws
3. Infringing upon the intellectual property rights of others
4. Harassing, abusing, insulting, harming or discriminating against others
5. Submitting false or misleading information
6. Uploading or transmitting viruses or any other malicious code
7. Collecting or tracking the personal information of others
8. Spamming, phishing, scraping or crawling
9. Interfering with or circumventing the security features of the service

We reserve the right to terminate your use of the service for violating any of the prohibited uses.

11. Disclaimer of Warranties and Limitation of Liability

As most ShopZ products carry a Brand Warranty or Manufacturer Warranty, customers may avail warranty through ShopZ where mentioned on the product page. However, any use of the product resulting in damage that falls outside the scope of the Brand or Manufacturer Warranty Policy will not make ShopZ liable.

12. Indemnification

You agree to indemnify, defend and hold harmless ShopZ and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

13. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our services, or when you cease using our site.

If in our sole judgment you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination.

15. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the applicable laws governing eCommerce in Bangladesh.
